Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the WrittenInStone platform, websites, and related services (collectively, the “Service”). By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, you may not use the Service.

2. Service description

WrittenInStone provides blockchain-based and cryptographic verification tools that allow users to generate immutable records, timestamps, and proofs of digital work. The Service may also include analytics, similarity detection, or third-party integrations.

We may modify or discontinue any part of the Service at any time, with or without notice, including features still in testing or beta phase.

3. Eligibility and account responsibility

  • The Service is intended for adults and professionals.
  • You are responsible for maintaining the confidentiality of your credentials and all activities under your account.
  • You agree to provide accurate information and not to impersonate any person or entity.
  • We reserve the right to suspend or terminate accounts that violate these Terms or applicable law.

4. User content and responsibility

You retain full ownership of any files, metadata, or data you upload or process through the Service. You are solely responsible for ensuring that such content:

  • does not infringe third-party intellectual property rights;
  • does not contain unlawful, offensive, or harmful material;
  • may legally be stored, transmitted, and processed under applicable law.

By using the Service, you grant WrittenInStone a limited, non-exclusive, royalty-free license to process your content as necessary to provide the Service. This includes generating cryptographic fingerprints, metadata extraction, and similarity analysis.

5. Data accuracy and verification results

The Service provides cryptographic proofs “as is”. Verification results indicate mathematical consistency only and do not certify authorship, legality, or originality. WrittenInStone does not act as a legal notary or certifying authority.

You are responsible for interpreting and using verification results in compliance with your own legal and professional standards.

6. Acceptable use

You agree not to:

  • use the Service for unlawful purposes or to violate any applicable laws or regulations;
  • interfere with or disrupt servers or networks connected to the Service;
  • reverse engineer, decompile, or attempt to extract source code from the platform;
  • use automated systems to overload or abuse the Service (e.g. scraping, denial-of-service);
  • upload or process materials that could compromise system security or others’ privacy.

7. Intellectual property

All software, text, design, and trademarks within the Service are owned by or licensed to WrittenInStone. You may not copy, distribute, or create derivative works based on any part of the platform without prior written permission.

8. Payment and subscriptions

Certain features may require a paid subscription. Prices and billing terms are published within the Service and may change with reasonable notice. Failure to pay may result in suspension or termination of access to paid features.

Unless otherwise stated, all fees are non-refundable except where required by law.

9. Third-party services

The Service may integrate with third-party systems (e.g. blockchain nodes, AI or similarity engines, payment processors). We are not responsible for third-party content or performance. Use of such services is subject to their own terms.

10. Metadata and system improvement

Anonymous or aggregated operational metadata may be analyzed to improve fraud prevention, reliability, and service performance.

Where similarity detection or verification features are enabled, processing may include technical derivatives of User Content (such as hashes, fingerprints, or previews) strictly for service operation and security. We do not use your User Content for advertising.

10.1 Data retention, availability, and backups

You are responsible for maintaining your own backups of any User Content and any records you wish to preserve. While we may provide optional features to store originals or maintain verification records, the Service is not a backup or archival service unless explicitly stated in the applicable plan.

We do not guarantee continuous availability of stored User Content, originals, previews, indexes, or verification links, and we may impose storage limits or remove content in accordance with these Terms and our Privacy Policy.

11. Disclaimer of warranties

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee uninterrupted or error-free operation, the accuracy of results, the continued availability of any stored content, or that any data will be preserved indefinitely.

You acknowledge that data loss, corruption, delays, or service interruptions may occur due to factors outside our reasonable control, including third-party providers, internet outages, security incidents, or force majeure.

12. Limitation of liability

To the maximum extent permitted by law:

  • WrittenInStone and its affiliates are not liable for any indirect, incidental, or consequential damages;
  • Total cumulative liability for all claims shall not exceed the total fees you paid (if any) in the last 12 months;
  • We are not responsible for loss of data, revenue, or goodwill arising from your use or inability to use the Service.
  • We are not liable for any loss, corruption, or unavailability of data, content, or verification records, to the maximum extent permitted by law.

Some jurisdictions do not allow certain exclusions or limitations; in such cases, liability is limited to the minimum extent permitted by law.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for intentional misconduct or gross negligence where such limitations are prohibited.

13. Indemnification

You agree to indemnify and hold harmless WrittenInStone, its officers, and employees from any claim, loss, or expense (including legal fees) arising from your misuse of the Service or violation of these Terms.

14. Suspension and termination

We may suspend or terminate your access at any time for violation of these Terms, suspected fraud, security risk, or compliance reasons. We may also terminate the Service generally with reasonable notice to users. If we discontinue the Service generally, we will make reasonable efforts to provide advance notice and, where technically feasible, a reasonable opportunity to export your data or verification records. We do not guarantee that export will be possible in all circumstances (for example, due to security incidents, legal requirements, or technical failures).

15. Changes to the Terms

We may update these Terms from time to time. Continued use after changes take effect means you accept the new version. The current version is always published on this page with its effective date.

16. Governing law and jurisdiction

These Terms are governed by the laws of EU, without regard to conflict-of-law principles. Any dispute will be resolved in the competent courts of that jurisdiction, unless mandatory consumer protection law provides otherwise.
